16 FEBRUARY 2010

Regular Council meeting called to order by President Mark Klug at 7 p.m..

Council & Staff Present:  Greg VanNeste, Robert Lumbardo, Elizabeth Hargrave, Debra Hlubic, Peter Frangedakis, President Mark Klug, Manager Chris Crary & Clerk Candy B. Franckowiak.

Council & Staff Absent:  Larry Adams.

Agenda:  Motion Elizabeth Hargrave, seconded by Greg VanNeste to approve the 16 February 2010 Agenda as presented.  All ayes.  Absent:  Larry Adams.  Motion carried.

Minutes:  Motion Debra Hlubic, seconded by Elizabeth Hargrave to approve the 01 February 2010 Regular Council Minutes as written.  All ayes.  Absent:  Larry Adams.  Motion carried.

Bills:  Motion Elizabeth Hargrave, seconded by Robert Lumbardo to approve the 16 February 2010 bills in the amount of $30,106.33.  Ayes:  Elizabeth Hargrave, Robert Lumbardo, Debra Hlubic, Peter Frangedakis, Greg VanNeste & President Mark Klug.  Absent:  Larry Adams.  Motion carried.

Correspondence:  
1.  Any interest in MML Conference in April.

Motion Elizabeth Hargrave, seconded by Greg VanNeste to close Regular Council Meeting for Public Hearing at 7:05 p.m..  All ayes.  Absent:  Larry Adams.  Motion carried.

Motion Greg VanNeste, seconded by Elizabeth Hargrave to re-open Regular Council meeting at 7:11 ½ p.m..  All ayes.  Absent:  Larry Adams.  Motion carried.

Motion Elizabeth Hargrave, seconded by Robert Lumbardo to approve 2009-10 Budget Amendments as presented.  Ayes:  Greg VanNeste, Peter Frangedakis, Debra Hlubic, Robert Lumbardo, Elizabeth Hargrave & President Mark Klug.  Absent:  Larry Adams.  Motion carried.

Personnel Committee Report:  Working on new Air Advantage contract.

Police Committee:  Working on next step with Police Chief position.

Clerk Report:  J & J Disposal trash bond:  Motion Debra Hlubic, seconded by Elizabeth Hargrave to give J & J Disposal until 9 a.m. Thursday February 18, 2010 to turn in the trash bond.  Ayes:  Elizabeth Hargrave, Robert Lumbardo, Debra Hlubic, Peter Frangedakis, Greg VanNeste & President Klug.  Absent:  Larry Adams.  Motion carried.

Manager’s Report:  
1.  Deer Park Report:  No information from the Association.
2.  Project Updates:
     A.  Aldrich St. water project – engineers will be bidding Aldrich St. water project           and lift station repair together.
    B.  MEDC Grant for Hunter Street:  Motion Elizabeth Hargrave, seconded by                Greg VanNeste to approve Resolution #2010-02 Supporting MEDC Grant for           Hunter Street.  Ayes:  Greg VanNeste, Peter Frangedakis, Debra Hlubic,                   Robert Lumbardo, Elizabeth Hargrave & President Mark Klug.  Absent:                   Larry Adams.  Resolution adopted February 16, 2010.

Planning Commission Report:
1.  Working on Wind Energy Ordinance – scheduled a workshop for Planning                Commission at 6 p.m. prior to Regular Meeting on March 3, 2010.

New Business:
1.  Greg VanNeste:  A.  Deer Park snow removal.  B.  Marijuana ordinance.  C.             D.P.W. lawn tractor rebuild. 
2. Peter Frangedakis:  Algeawheel – Motion Peter Frangedakis, seconded by Greg      VanNeste to allow Councilman Frangedakis, Manager Crary and Supt. Martin to     go to visit the Algeawheel facility in Indiana on March 4, 2010, contingent upon       letter from MDEQ approving the Algeawheel system in Michigan and allowing         reasonable expenses turned in for trip.  Ayes:  Elizabeth Hargrave, Robert                Lumbardo, Debra Hlubic, Peter Frangedakis, Greg VanNeste & President Mark     Klug.  Absent:  Larry Adams.  Motion carried.

Unfinished Business:
A.  Dangerous building 415 N. Walker St. – leave on.
B.  Safe routes to school – leave on.
C.  Sidewalk to Capac Food Center & research on grants – leave on.
D.  Codification of ordinances – leave on.
E.  William G. Drive barrier between school & residents – leave on.

Council Business:
1.  Greg VanNeste – read Times Herald opinion written on EDA.

Adjournment:  Motion Greg VanNeste, seconded by Elizabeth Hargrave to adjourn.  All ayes.  Absent:  Larry Adams.  Motion carried and meeting adjourned at 8:13 p.m..
