Regular Council Meeting called to order by President Mark Klug at 7:03 p.m..

Council & Staff Present:  Greg VanNeste, Elizabeth Hargrave, Robert Lumbardo, Larry Adams, Debra Hlubic, Peter Frangedakis, President Mark Klug, Manager Chris Crary & Clerk Candy B. Franckowiak.

Agenda:  Motion Elizabeth Hargrave, seconded by Greg VanNeste to approve the 19 July 2010 Agenda with additions:  under Managers Report add:  7.  Investment Group.  8.  Building Code update.  All ayes.  Motion carried.

Minutes:  
1.  Motion Greg VanNeste, seconded by Debra Hlubic to approve the 21 June 2010 Regular Council Minutes as presented.  All ayes.  Motion carried.
2.  Motion Debra Hlubic, seconded by Greg VanNeste to approve the 21 June 2010 Public Hearing 2009-10 Budget Amendments Minutes as presented.  All ayes.  Motion carried.  
3.  Motion Debra Hlubic, seconded by Greg VanNeste to approve the 28 June 2010 Special Council Meeting 2009-10 Budget Amendments as presented.  All ayes.  Motion carried.

Bills:
1.  Motion Elizabeth Hargrave, seconded by Greg VanNeste  to approve the 30 June 2010 End of Year Bills in the amount of $42,063.50.  Ayes:  Larry Adams, Greg VanNeste, Peter Frangedakis, Debra Hlubic, Robert Lumbardo, Elizabeth Hargrave & President Mark Klug.  Motion carried.
2.  Motion Greg VanNeste, seconded by Debra Hlubic to approve the 19 July 2010 bills in the amount of $41,048.18.  Ayes:  Elizabeth Hargrave, Robert Lumbardo, Debra Hlubic, Peter Frangedakis, Greg VanNeste, Larry Adams & President Mark Klug.  Motion carried.

Correspondence:  
1.  Council on Aging – Regarding selling the Village their property.

Visitors:
1.  Jim Downey – Candidate for Circuit Judge.
2.  Karl Jaros – School sent letter to William G. Drive residents offering a fence.

Police Committee Report:  Still negotiating.

D.P.W. Committee Report:  Still negotiating.

Treasurer Report:
1.  Motion Elizabeth Hargrave, seconded by Debra Hlubic to approve the 2010 Park & Recreation Distribution Request.  Ayes:  Larry Adams, Greg VanNeste, Peter Frangedakis, Debra Hlubic, Robert Lumbardo, Elizabeth Hargrave & President Mark Klug.  Motion carried.

Managers Report:
1.  Air Advantage:  Motion Elizabeth Hargrave, seconded by Greg VanNeste to approve the Air Advantage contract as presented.  Ayes:  Elizabeth Hargrave, Robert Lumbardo, Debra Hlubic, Peter Frangedakis, Greg VanNeste, Larry Adams & President Mark Klug.  Motion carried.
2.  Union contracts – Police & D.P.W. Union meetings set for July 20, 2010.
3. A.  Motion Greg VanNeste, seconded by Elizabeth Hargrave to approve Manager to sign Block Grant awarded from MEDC in the amount of $187,500, Village share $62,500.00 subject to attorney approval.  Ayes:  Larry Adams, Greg VanNeste, Peter Frangedakis, Debra Hlubic, Robert Lumbardo, Elizabeth Hargrave & President Mark Klug.  Motion carried.
B.  Motion Elizabeth Hargrave, seconded by Greg VanNeste to have Manager sign Design Phase for Engineering for Hunter St. paving not to exceed $18,000.00.  Ayes:  Elizabeth Hargrave, Robert Lumbardo, Debra Hlubic, Peter Frangedakis, Greg VanNeste, Larry Adams & President Mark Klug.  Motion carried.
4.  2 Mill Street millage language turned over to attorney for review & suggestions.
5.  Aldrich St. water main contract award – bids received and background checks being done.
6.  Sewer rate proposal – Motion Elizabeth Hargrave, seconded by Robert Lumbardo to approve the Proposed increase in water for outside village and sewer for inside and outside village.  Ayes:  Elizabeth Hargrave, Robert Lumbardo, Debra Hlubic & President Mark Klug.  Nays:  Peter Frangedakis, Greg VanNeste & Larry Adams.  Motion died due to lack of two thirds majority vote.
7.  Investment group – consensus of Council to not pursue.
8.  Building Code Update – will bring back to next meeting with more information.

DDA Report:  Next meeting August 2, 2010.

Planning Commission Report:  Still working on wind energy.

Police Report: 
1.  Motion Elizabeth Hargrave, seconded by Greg VanNeste to allow Chief to hire Alan Przywara as a part time officer.  Ayes:  Larry Adams, Greg VanNeste, Peter Frangedakis, Debra Hlubic, Robert Lumbardo, Elizabeth Hargrave & President Mark Klug.  Motion carried.
2.  Motion Elizabeth Hargrave, seconded by Larry Adams to table Proposed Ordinance #2010-01 TO AMEND CHAPTER 26 ARTICLE II AND ARTICLE III OF THE CODE OF ORDINANCE OF THE VILLAGE OF CAPAC.  Ayes:  6.  Nays:  1.  Motion carried.

D.P.W. Report:  Motion Debra Hlubic, seconded by Elizabeth Hargrave to table Lawn mowing bids, to be put on next meeting agenda under Unfinished Business.

President’s Report:  Chamber of Commerce meeting Tuesday July 20, 2010 at Louie’s at 8 a.m..

New Business:
1.  Manager informed Council Mayor Exchange with Brown City will be here at 1 p.m. Wednesday August 11, 2010 and in Brown City at 1 p.m. Wednesday August 18, 2010.

Unfinished Business:
A.  Dangerous building 415 N. Walker St. – Attorney talked with County Treasurer – the County has no plans to tear down.
B.  Safe routes to school – leave on.
C.  Sidewalk to Capac Food Center and research on grants – leave on.
D.  Codification of ordinances – leave on.
E.  William G. Drive barrier between school & residents – leave on.

Public Comment:
1.  Dale Barnard – Complaints on Comcast Channel 6 advertising.
2.  Karl Jaros – Moratorium on selling marijuana in the Village.

Council Business:
1.  Greg VanNeste – Truck traffic on E. Mill – responsibility for street.

Adjournment:  Motion Robert Lumbardo, seconded by Elizabeth Hargrave to adjourn.  All ayes.  Motion carried and meeting adjourned at 9:18 p.m..
