Request for Proposals: Village of Capac Property Development
The Village of Capac Downtown Development Authority (“DDA”) invites qualified developers to submit proposals for the purchase and redevelopment of the property located at 135 N. Main St., Capac, Michigan, together with a potential adjacent development component involving a neighboring Village-owned building.
A. Project Overview
The Village of Capac is seeking to redevelop property located within the Village’s DDA District. The DDA intends to offer the property for redevelopment through this Request for Proposals (“RFP”). In addition, the Village owns the building immediately adjacent to the subject property. The area potentially available for inclusion is approximately 1,200 square feet, subject to final approval and transaction terms acceptable to the Village DDA.
B. Development Requirements
1. Facade Preservation.
The redevelopment proposal must preserve the original look and character of the facade of 135 N. Main St. The facade preservation is essential to theproject. Respondents should include:
A description of how the existing facade will be preserved, restored, rehabilitated, or incorporated into the redevelopment;
Conceptual drawings, renderings, or narrative descriptions sufficient to explain the proposed treatment of the facade
Any anticipated use of available facade-improvement funding.
2. Liquor License Requirement.
The selected developer must obtain, within one (1) year after closing, and the proposal should state the respondent’s plan for satisfying this requirement by either obtaining:
A redevelopment liquor license, if available and approved through the applicable regulatory process; or
A liquor license obtained privately in compliance with applicable law.
3. Regulatory Compliance.
The proposal should demonstrate sensitivity to the history, character, and context of the downtown area. While complying with all applicable building, plumbing, and fire codes; and state and federal laws and regulations.
C. Property Transfer Conditions and Reserved Rights
This RFP is intended to solicit redevelopment proposals only. The final terms of any sale, development approval, or transfer will be governed by separately negotiated agreements approved the Village. The DDA anticipates requiring the following protections in the final transaction documents:
If the redevelopment fails, ceases, is abandoned, or otherwise does not proceed in accordance with the final approved development plan within the first ten (10) years after closing, the DDA intends to reserve a right of first refusal, repurchase right, or similar contractual protection, as more specifically set forth in the final transaction documents.
The selected respondent will be required to enter into a purchase agreement, development agreement, deed restriction, or other recorded instruments as determined necessary by the DDA and its legal counsel. The DDA reserves the right to negotiate these protections and related enforcement mechanisms with the selected respondent.
D. Submission Requirements
Each proposal should include the following:
1. Respondent Information
Legal name of the developer or entity submitting the proposal
Business address
Primary contact person
Telephone number, email address
Legal structure of the entity
Identification of partners, principals, or members of respondent entity
2. Qualifications and Experience
Description of the firm’s licensure and qualifications;
• Experience with similar redevelopment projects; and
History of successful real estate development, rehabilitation, adaptive reuse, or mixed-use projects
3. Development Concept
Description of the proposed use
Conceptual development plan
Anticipated timeline
Plan for preserving the facade of 135 N. Main St.
4. References
Preferred at least three references for comparable projects completed by the respondent or principal team members.
E. Evaluation Criteria
The DDA may consider the following factors in evaluating proposals:
Responsiveness to this RFP;• demonstrated qualifications and experience of the respondent
Strength and feasibility of the redevelopment plan
Preservation of the original facade of 135 N. Main St.
Financial capacity
Quality and completeness of the submission
Ability to satisfy the liquor-license requirement within one year of closing
Overall benefit to the downtown district and community
The Village reserves the right to:
Reject any or all proposals
Waive informalities or irregularities in any proposal
Request additional information from any respondent
Interview respondents
Negotiate with one or more respondents
Issuance of this RFP does not obligate the DDA or the Village to sell any property, enter into any agreement, or approve any proposed redevelopment. Respondents are advised that proposals submitted to a public entity may become subject to disclosure under the Michigan Freedom of Information Act
